Terms and Conditions

Carrier Liability Notice

When shipping internationally with The Eagles Company, your cargo may be subject to the provisions of the Montreal Convention or the Warsaw Convention, depending on the route and destination. These international treaties set the rules for carrier liability, including limitations on compensation in the event of loss, damage, or delay to goods. Should you wish to increase the value declared for carriage and, subsequently, the carrier’s liability, this can bearranged for an additional fee.

Conditions of Carriage

a. Carrier Definition

“The Eagles Company” includes the freight forwarder, any air carriers issuing air waybills, and all carriers involved in the transport or related services for the shipment.

b. International Conventions

Shipments are governed by the Montreal or Warsaw Convention, based on the destination, regulating liability for international shipments.

c. Additional Conditions of Carriage

Carriage is also subject to applicable laws, government regulations, and The Eagles Company

Company’s terms and conditions. These include, but are not limited to:

  • Liability limits for lost, damaged, or delayed cargo, including perishable or fragile goods.
  • Claims restrictions, outlining specific timeframes within which a claim or legal action must be filed.
  • The right of the carrier to refuse carriage under certain conditions.
  • Terms regarding potential schedule changes, rerouting, and substitution of carriers or aircraft. Liability Limits

If the Montreal Convention does not apply,  The Eagles Company limits its liability for loss, damage, or delay to 19 Special Drawing Rights (SDRs) per kilogram of cargo. However, shippers have the option to declare a higher value for their cargo and pay a supplemental charge to increase the carrier’s liability.

 

e. Shipper’s Responsibility

The shipper is responsible for complying with all relevant laws and regulations,  including those related to the packing, transport, and delivery of goods. It is theshipper’s duty to provide accurate documentation and ensure that all necessaryinformation is attached to the air waybill.

f. Claims and Complaints

Any claims regarding damage, delay, or loss of cargo must be submitted in writing

within the designated timeframes:

  • Damage: Within 14 days of cargo receipt.
  • Delay: Within 21 days of cargo delivery.
  • Non-delivery: Within 120 days from the air waybill issue date.

g. General Liability

The rights to damages will expire if legal action is not brought within two years of the cargo’s arrival or the expected arrival date.

h. Shipper Indemnity

The shipper must comply with all applicable regulations and laws. The Eagles Company will not be liable for losses arising from the shipper’s failure to comply, and the shipper agrees to indemnify the carrier against any resulting losses or expenses.

i. No Modification Authority

No agent or employee of The Eagles Company has the authority to modify or waive any terms of this contract.
